GUARDIANSHIP

A guardian is a person who has been entrusted by the lasw to care for another person or for his estate or for both. The Probate Court appoints a person to make personal decisions on behalf of another person who is judged to be unable to make informed decisions about his care. The guardian makes decisions regarding personal care, but is not financially responsible for the person's care. A parent or other family member may want to seek guardianship for a relative who is mentally ill for one of the following reasons:

  • The guardian can help the person with mental illness by ensuring that he is living in a safe place or receives needed medical attention. The guardian may authorize a voluntary admission if the relative agrees. A guardian cannot, however, authorize involuntary hospitalization.

  • The guardian has full access to medical records; information which may otherwise be impossible to obtain.
